These Terms of Service ("Terms") govern your access to and use of the BrokerHub platform, including all associated websites, applications, tools, and services (collectively, the "Service"), operated by BrokerHub ("we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age and a licensed real estate professional in your jurisdiction to use the Service. By registering, you represent and warrant that you meet these requirements.
You agree to provide accurate, current, and complete information during the onboarding process and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You may use the Service solely for lawful purposes related to your real estate business. You agree not to:
You retain ownership of all content you upload to the Service, including but not limited to photos, logos, documents, and listing data ("Your Content"). By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process Your Content solely to provide and improve the Service.
You represent and warrant that you have the right to upload and use all content you submit, including any OREA forms and listing photographs.
Access to the Service may require payment of subscription fees as described on our website or in a separate agreement. All fees are quoted in Canadian dollars and are non-refundable except as expressly stated in these Terms or required by law. We reserve the right to change our pricing with 30 days' written notice.
The Service, including its design, features, code, and documentation, is owned by BrokerHub and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except the limited right to use it in accordance with these Terms.
The Service may integrate with third-party platforms (e.g., GoHighLevel, IDX providers, Zapier). We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of third-party integrations is subject to their respective terms and policies.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, BrokerHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service. Our total liability for any claim arising under these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless BrokerHub, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or your breach of these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. You may cancel your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive (e.g., indemnification, limitation of liability) will remain in effect.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
